Welcome to SimCell BH. These Terms of Service govern your use of our mobile top-up platform and services. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using SimCell BH services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be responsible for all activities under your account

3. Service Description

SimCell BH provides mobile top-up services including:

  • Instant mobile balance recharge
  • Multiple payment technology options (NFC, QR codes, biometric authentication, voice commands)
  • Automated top-up scheduling
  • Transaction history and reporting
  • Multi-operator support for Bahrain mobile networks

4. Account Registration

4.1 Account Creation

You must create an account to access certain features. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are solely responsible for all activities that occur under your account. SimCell BH is not liable for any loss or damage arising from unauthorized use of your account.

5. Payment Terms

5.1 Transaction Processing

All payments are processed securely through encrypted channels. You authorize us to charge the payment method you provide for all top-up transactions.

5.2 Pricing and Fees

Top-up amounts correspond to the value added to your mobile balance. We reserve the right to modify our pricing structure with reasonable notice.

5.3 Transaction Limits

We may impose transaction limits for security purposes. These limits may vary based on your account history and verification status.

6. Auto Top-Up Service

If you enable auto top-up features:

  • You authorize automatic charges based on your configured settings
  • You can modify or cancel auto top-up at any time through your account
  • You are responsible for ensuring sufficient funds in your payment method
  • We will notify you before processing automated transactions

7. Refund and Cancellation Policy

7.1 Successful Transactions

Once a top-up is successfully completed and credited to your mobile account, it cannot be refunded or reversed.

7.2 Failed Transactions

If a transaction fails but your payment method was charged, we will process a refund within 5-7 working days.

7.3 Erroneous Transactions

If you believe a transaction was processed in error, contact our support team immediately at +973 1729 8888.

8. User Obligations

You agree not to:

  • Use the services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the platform
  • Use automated systems to access the services without permission
  • Reverse engineer or attempt to extract source code
  • Violate any applicable laws or regulations
  • Impersonate another person or entity
  • Transmit viruses or malicious code

9. Intellectual Property

All content, features, and functionality of SimCell BH, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of SimCell BH and are protected by international copyright, trademark, and other intellectual property laws.

10. Service Availability

While we strive for 24/7 availability, we do not guarantee uninterrupted access to our services. We may suspend or modify services for maintenance, updates, or improvements without prior notice.

11. Limitation of Liability

To the maximum extent permitted by law:

  • SimCell BH is not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount of your most recent transaction
  • We are not responsible for delays or failures caused by mobile operators
  • We are not liable for losses due to unauthorized account access

12. Indemnification

You agree to indemnify and hold SimCell BH harmless from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

13. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your personal information in accordance with Bahrain's data protection laws.

14. Third-Party Services

Our platform may integrate with third-party payment processors and mobile operators. We are not responsible for the availability, accuracy, or content of third-party services.

15. Termination

15.1 By You

You may terminate your account at any time by contacting our support team.

15.2 By Us

We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent activities.

16. Dispute Resolution

Any disputes arising from these terms or your use of our services shall be resolved through:

  • Initial contact with our customer support team
  • Good faith negotiations between parties
  • Arbitration in accordance with Bahrain law if necessary

17. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Bahrain. Any legal action or proceeding shall be brought exclusively in the courts of Bahrain.

18. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notification. Continued use of our services after changes constitutes acceptance of the modified terms.

19. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
